SMS & TEXT MESSAGING POLICY
Texting is separate. Always.
Hard Earned Happy does not currently operate a marketing text program. These terms state the controls that must be in place before one is launched.
Separate permission
SMS marketing requires a separate, unchecked, clearly labeled consent. Email permission, a purchase, customer-account creation, and Payday Club enrollment do not create SMS permission. Consent to marketing texts is not a condition of purchase or Club membership.
Before any text is sent
The signup must name Hard Earned Happy, describe recurring automated marketing texts, state that message frequency varies, disclose that message and data rates may apply, link these terms and the privacy notice, and explain STOP and HELP. The system must store the displayed disclosure, number, source, timestamp, and policy version.
Stop and help
Once launched, replying STOP must end marketing texts and create a durable suppression record. HELP must return assistance and a current support channel. A later opt-in cannot silently override an unresolved carrier, complaint, or legal suppression.
Data use
Mobile opt-in data and consent are used to operate the requested messaging program and are not sold or shared with third parties for their own marketing. Service providers may process the data only to deliver, secure, measure, and support the program as described in the privacy notice.
Questions
Until a compliant SMS program is visibly launched, guests should not expect promotional texts from Hard Earned Happy. Contact privacy@hardearnedhappy.com with a text-message consent or suppression question.
